These Terms govern your use of iPGaze (the “Service”), operated by Middlesurf Inc., a company based in Canada. By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

The service

iPGaze provides free online network, DNS, IP, email, security, SEO and developer tools for informational and diagnostic purposes. The Service is provided on an “as is” and “as available” basis and may change or be discontinued at any time.

Acceptable Use Policy

You agree that you will not:

• Use the active tools (including ping, traceroute, port check, SSL/HTTP checks and any scanning feature) against any host, network or system that you do not own or do not have explicit authorization to test. Unauthorized scanning or probing may be illegal in your jurisdiction.
• Use the Service to attack, overload, disrupt or gain unauthorized access to any system, or to facilitate any unlawful, fraudulent or abusive activity.
• Send spam or malicious content through the contact form.
• Circumvent rate limits, scrape the Service at scale, or use automated means that place an unreasonable load on our infrastructure.
• Violate any applicable law, regulation or third-party rights.

We may rate-limit, block, or disable any tool or user, and remove content, at our discretion to protect the Service and third parties.

No warranty & accuracy

Results from the tools (including geolocation, WHOIS, DNS, blacklist, ASN and security data) come from third-party and public sources and may be inaccurate, incomplete or out of date. We make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy or non-infringement, and we do not guarantee availability, security or error-free operation.

Limitation of liability

To the maximum extent permitted by law, iPGaze and its operators will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of — or inability to use — the Service or its results. You are solely responsible for how you use the Service and any results obtained.

Indemnification

You agree to indemnify and hold harmless iPGaze and its operators from any claims, damages or expenses arising from your misuse of the Service or your violation of these Terms or any law.

Third-party services and links

The Service relies on and links to third-party services. We are not responsible for their content, availability or practices. Your use of them is governed by their own terms.

Intellectual property

The Service’s software, design and content are owned by us or our licensors and may not be copied or redistributed except as permitted by law.

Governing law

These Terms are governed by the laws of Canada and the applicable province in which Middlesurf Inc. is established, without regard to its conflict-of-laws principles.
